  • I need some advice... i ordered something from ebay for Danielles birthday and when it arrived the package was tampered with and the item had been removed, it was from Canada and so for customs reasons in said it was cosmetics on the outside sticker

I emailed the seller and told them what had happened and they asked whether it had been tampered with and i said yes, now whats the deal with this? Is the seller obliged to give the money back or what? It was nearly £40 so i dont want to just lose the money!
WANTED... saxo rolling shell, no rust wanted!

  • The seller is not responsible for postage. So if it gets damaged or lost in post its not there problem. General most postal services have insurance to cover such things. But as you said its only listed as £40 so its likely you will not be able to get any more back than the £40 and possibly the actual postage costs. Generally its the sender that should contact the company involved and ask for the money back. But saying this if you paid by paypal you could always claim the item was not as described. Annoyingly paypal often pays up on these things at the sellers pain. I really do hate paypal

the seller is responsible for postage and if it is lost or damaged it is their problem

paypal item significantly not as described claim = you have to return the item by a trackable service at your cost then get a paypal refund if the seller signs for it

paypal item not received claim = full paypal refund for you unless seller sent it to you by a trackable service and they can prove delivery to you

the seller can claim from their courier for loss/damage

  • hopefully the seller will do the right thing and give you a full refund without you having to get ebay or paypal involved

sellers are responsible for ensuring you received the item you paid for

  • i suppose you shouldnt have signed for it if was obvious it was damaged , left it for the post office to return to sender , had it been taped up to prevent you knowing the item was actually missing from the packaging?

as far as i\'m aware - anything under £18 is ok, anything under £36 is ok if marked as a gift, but over that and you risk having to pay approx 20-30% of the value in customs and handling

the handling fee is about £8 from royal mail or £12/£13 for parcelforce

if the seller doesn\'t give you a full refund i\'d do a paypal item not received claim then

the only way you would lose would be if the seller entered a tracking no to show that item was signed for/delivered. so if you didn\'t sign for it then you can\'t lose.

  • This happened to me on some jewellery I bought.  They just ripped the envelope and taken it out. I emailed the seller and they sent a new one within a week.  I\'d taken photos but they didn\'t even ask me for it, they amended the customs info on the 2nd package though.  Wise move.

ok, make sure you have kept the item you received (and maybe packaging) because if paypal find in your favour then they\'ll probably ask you to return it to the seller by a trackable service at your expense (airmail cost plus approx £4 for tracking)

you\'ll then have to wait for it to be delivered to and signed for by the seller before paypal to refund - and hope they are in when its delivered and that they don\'t refuse delivery of it

hope it works out ok for you
